Trump Administration Advances 401(k) Crypto Access, DOL Submits Regulatory Framework to White House

According to the Department of Labor filing submitted on November 5, the DOL has sent a proposed regulatory framework to the White House that would allow 401(k) retirement plans to include cryptocurrency and other alternative investments. The move follows President Trump's August 2025 executive order directing federal agencies to expand investment options for retirement accounts beyond traditional assets.

US 401(k) plans held approximately $10.8 trillion in assets as of June 2026. According to the Investment Company Institute, a 2% allocation of those assets to cryptocurrency could represent approximately $216 billion in potential inflows. The proposed framework establishes six evaluation areas for fiduciaries assessing alternative investments: performance, fees, liquidity, valuation, performance benchmarks, and investment complexity. The White House must complete its review before the Labor Department can finalize the rule.
